Laos Customs presently are only able to take enforcement action against suspected trademark, and copyright infringements. They have the legal authority to enforce IP rights at importation exportation and transiting goods can only be inspected on the basis of intelligence and application of suspension received.

Laos Customs operate a de minimis exemption to the importation of IP Infringing goods. There is no set article limit, but is subject to the value being less than the other goods allowance available to travellers and not being regarded as commercial by the officer handling the situation.

Currently Laos Customs does not have a formal IPR Recordation system. Holders or authorized representatives of right holders and lodge application for suspension in hard copy..

After the IPR infringing goods are suspended at the border, Customs will send notice of suspension to the right holders to inform the right holders to take judicial action, Customs may maintain the suspension for 10 working days. However, suspension may continue if the applicant has provided evidence that judicial action has been initiated. The applicant must initiate judicial action with the Court against the owner of the allegedly infringing goods within 10 working days upon receipt of the notice of suspension. Failure to initiate judicial action within the statutory time entitles the customs officer to release the goods immediately and to enforce the applicant to compensate for damages suffered by the owner of the goods.

Currently React Laos is our representative office in Laos. According to Investment Promotion Law of Laos, after 1 or 2 years of operation, React shall apply to be the React Laos Branch.
