Kazakhstan, bordering with China and with Russia, and being party to the Eurasian Customs Union, is an important gateway for business in the region. In 2016  REACT entered into partnership agreement with a Kazakh lawyer  to able to offer services there. Actions in Kazkahstan are coorinated by REACT North East Europe office. The practice on anti-counterfeiting actions is still being developed in Kazakhstans, however there are procedures in place for customs control as well as for the control of trade in counterfeit goods in the internal market. Based on the customs recordal, the customs control the shipments on the border. Administrative or criminal procedure is applied if counterfeit goods are detected. Cases of trade in the internal market are handled through administrative procedure initiated with the Ministry of Justice or through criminal procedure initiated with the police.

Country Procedures

  • Customs application procedure is available and mandatory for the customs control
  • The Customs application is valid for 1 year
  • Customs seizures are handled through administrative or criminal procedure
  • Customs notification must be responded within 10 business days
  • Administrative cases against traders in counterfeit goods are initiated with the Ministry of Justice. In cases of high damage caused by the sellers, criminal cases are initiated with the police.
