Colombia, officially the Republic of Colombia, is a unitary, constitutional republic comprising thirty-two departments. It is located in northwestern South America, bordered to the northwest by Panama, to the north by the Caribbean Sea, to the east by Venezuela and Brazil, to the south by Ecuador and Peru, and to the west by the Pacific Ocean. Colombia protects intellectual property (IP) assets, including patents, designs, trademarks, trade secrets, copyrights (actually author rights) and plant breeder's rights. Colombia's IP laws and regulations are in general TRIPS compliant. Colombia is the only country in South America with two seacoasts (Pacific and Caribbean). During the last years Colombia continues strengthening its trade opening process unilaterally or through free trade agreements, highlighting the strong ties to the United States.

Country Procedures

  • Customs application available
  • Customs application is valid until the registered trademark remains valid and the POA is in force
  • Simplified procedure in case of ex officio procedures
  • Deadline for response to Customs notification of detention is 5 days (inspection), 10 days (filing of the criminal complaint as from notification of the suspension). It can be extended by Customs depending on the particularities of the case
  • Deadline for importer to respond to seizure is 10 days (appeal for reversal) as from notification of the resolution ordering the suspension of Customs procedure
  • Local authorities tasked with taking criminal action against infringers are Police, Prosecutor and Judge
  • Remedies available under law: imprisonment and fine
  • Proof of knowledge of counterfeiting is required
  • Interim injunctions, contributory liability remedy, damages and costs are all available
